Refund Policy

At EvolvAI, we are committed to providing high-quality AI solutions and ensuring that our clients are satisfied with the services we offer. However, due to the nature of our bespoke solutions and the significant amount of work that goes into delivering tailored AI services, we have a specific Refund Policy that applies to all paid services and products.

By using our Services, you agree to the terms of this Refund Policy, which is outlined below:
 

1. Refund Eligibility

We offer refunds only in the event that EvolvAI fails to deliver the agreed-upon AI solution or service, as per the terms and scope outlined in the signed contract. A refund may be considered under the following circumstances:

  • Failure to Deliver the Solution: If EvolvAI is unable to deliver the agreed-upon solution within the specified timeframe, and such failure is due to EvolvAI's fault, a refund may be issued. However, this is subject to the terms outlined below.

  • Limited Scope of Refund: If a refund is granted, it will only cover the amount paid for the specific solution or service that was not delivered, excluding any non-refundable labor fees or costs already incurred.
     

2. Non-Refundable Labor Fees

As part of the services we provide, we invest significant time, resources, and expertise into designing, developing, and implementing each custom AI solution. Therefore, in the event of a refund request, a labor fee will be applied to cover the time and resources already spent on your project.

  • Labor Fees: These fees are non-refundable and will be charged for the work done on your project, including but not limited to planning, research, design, development, testing, and consultation. The labor fee will be calculated as per the agreed hourly or flat rate specified in your contract.

  • Amount of Refund: If a refund is applicable, the refund will be issued after deducting the labor fees and any additional costs that have been incurred in the development of your solution.
     

3. Conditions for a Refund

Refund requests must meet the following conditions to be considered:

  • The client must provide a written request for a refund within 30 days from the agreed-upon delivery date.

  • The request must include specific details of how the solution or service fails to meet the requirements outlined in the contract.

  • A failure to deliver is defined as an inability on our part to produce the agreed-upon solution, not due to changes requested by the client, delays caused by the client, or any external factors outside of EvolvAI’s control.

  • The client must cooperate with us to resolve any issues or make necessary revisions before the refund request is processed. We reserve the right to resolve any issues within a reasonable period before issuing a refund.
     

4. Exclusions from Refunds

The following situations are not eligible for a refund:

  • Customer Change of Mind: If you simply change your mind, decide not to proceed with the project, or are dissatisfied with the AI solution after the completion or delivery of the service.

  • Scope Creep: Any alterations to the scope of the project, including additional features or functionality requested after the contract has been signed, do not entitle the client to a refund. Any scope changes may result in additional fees.

  • Client Delays: If the project is delayed due to the client’s failure to provide necessary information, approvals, or cooperation, we will not be responsible for any delays in delivery, and no refunds will be issued for delays caused by the client.

  • External Factors: If the failure to deliver the solution is caused by external factors, such as third-party services, hardware issues, or technical limitations beyond EvolvAI's control, a refund will not be applicable.
     

5. Refund Process

In the event that a refund is granted under the terms outlined above, the following process will apply:

  • The client must submit a formal refund request in writing to EvolvAI within the timeframe specified in this policy.

  • EvolvAI will review the request and verify the eligibility for a refund, considering the reasons for the failure to deliver and any applicable labor fees.

  • If a refund is granted, the remaining balance after the deduction of labor fees and any incurred costs will be processed and refunded to the client. The refund will be issued through the same payment method used for the original transaction.

  • Refunds will be processed within 30 days of the approval of the refund request.
     

6. Right to Refuse Refunds

EvolvAI reserves the right to refuse a refund request if:

  • The failure to deliver is due to circumstances outside of our control, including but not limited to natural disasters, government restrictions, or third-party service failures.

  • The client has failed to cooperate with EvolvAI in resolving any issues, providing necessary feedback, or approving interim deliverables as part of the project.

  • The client has violated any terms of the contract or engaged in activities that affect the quality or progress of the project.
     

7. Dispute Resolution

If a refund request is not resolved to the satisfaction of the client, the client agrees to engage in good faith discussions to resolve the dispute before taking any further action. If the dispute cannot be resolved through discussion, the matter will be subject to the exclusive jurisdiction of the courts in the UAE.
 

8. Changes to This Refund Policy

EvolvAI reserves the right to amend this Refund Policy at any time. Any changes will be communicated to clients and will apply to new contracts or services after the changes have been made. Clients will be notified of any modifications to the refund terms before engaging in any new transactions or services.
